Open Internet Transparency Disclosure
Introduction
Never-Enuff Internet and Computer Services ("we," "our," or "us") is committed to operating our fixed wireless broadband network in an open and transparent manner. This Network Management Policy describes our network management practices in accordance with the Federal Communications Commission's (FCC) Open Internet Transparency rules.
We provide fixed wireless internet service to residential and small business customers in Cambria, Indiana, Clearfield, and surrounding counties in Pennsylvania. Our goal is to deliver reliable, high-quality internet access while ensuring fair treatment for all users and traffic on our network.
1. Blocking Practices
Never-Enuff Internet does not block lawful content, applications, services, or non-harmful devices. We do not prevent users from accessing lawful websites, running lawful applications, using lawful services, or connecting non-harmful devices to our network.
Exceptions:
- We may block traffic that is determined to be malicious, harmful, or illegal, including but not limited to: malware distribution, denial-of-service attacks, network intrusion attempts, and child sexual abuse material (CSAM).
- We may block traffic from IP addresses identified as sources of spam, malware, or other network abuse.
- We may block or restrict access to services for customers whose accounts are past due or suspended in accordance with our Terms of Service.
2. Throttling Practices
Never-Enuff Internet does not engage in throttling or degradation of lawful internet traffic based on content, application, service, user, or use of non-harmful device. All lawful traffic is treated equally regardless of its source, destination, or type.
Speed Tier Limitations: Customers subscribe to service plans with specific download and upload speed tiers. These speed limits apply equally to all traffic types and are not considered throttling. Speed tiers are disclosed on our FCC Broadband Nutrition Labels and in our service agreements.
3. Paid Prioritization
Never-Enuff Internet does not engage in paid prioritization. We do not accept payment from third parties (such as content providers, application developers, or other entities) to prioritize their traffic over other traffic on our network. All lawful traffic receives equal treatment regardless of any commercial arrangements.
4. Affiliated Prioritization
Never-Enuff Internet does not prioritize content or services from any affiliated entities over non-affiliated content or services. We do not own or operate any content delivery services, streaming platforms, or other online services that would benefit from preferential treatment on our network.
5. Congestion Management
As a fixed wireless internet service provider, network capacity is a shared resource among customers connected to each access point and backhaul link. We employ the following congestion management practices to ensure fair access for all users:
Quality of Service (QoS): We may implement Quality of Service policies that prioritize certain types of time-sensitive traffic (such as VoIP or video conferencing) to maintain acceptable performance during periods of network congestion. These policies apply equally to all customers and all sources of such traffic.
Fair Queuing: During periods of congestion, bandwidth is allocated fairly among active users on the affected network segment. No single user can monopolize available bandwidth at the expense of other users.
Network Monitoring: We continuously monitor our network for congestion and capacity issues. When persistent congestion is detected, we work to upgrade affected network segments to provide additional capacity.
6. Application-Specific Behavior
Never-Enuff Internet does not engage in application-specific network management practices that single out particular applications or classes of applications for different treatment. We do not block, throttle, or degrade any specific applications, protocols, or services.
All lawful applications are treated equally on our network, including but not limited to: streaming video, gaming, VoIP services, peer-to-peer applications, VPN services, and remote desktop applications.
7. Device Attachment Rules
Customers may connect any lawful, non-harmful devices to their internet connection through their customer premises equipment (router). The following rules apply:
- Customer Premises Equipment (CPE): The outdoor radio/antenna unit provided by Never-Enuff Internet remains our property and must not be modified or tampered with. This equipment is required to receive our fixed wireless signal.
- Router/Network Equipment: Customers may use their own router or networking equipment behind our network interface device. We provide a standard router at installation, but customers are free to use alternative equipment of their choosing.
- Connected Devices: Customers may connect any devices (computers, smartphones, smart home devices, gaming consoles, etc.) to their home network without restriction.
- Harmful Devices: Devices that cause harm to the network (such as devices sending malicious traffic, causing interference, or otherwise degrading service) may be subject to restrictions or service suspension per our Acceptable Use Policy.
8. Security Practices
Never-Enuff Internet takes reasonable measures to protect the security and integrity of our network and our customers' traffic. Our security practices include:
- Firewall Protection: We maintain network-level firewalls to protect against malicious traffic and common attack vectors.
- DDoS Mitigation: We employ measures to detect and mitigate distributed denial-of-service attacks that may affect our network or customers.
- Abuse Monitoring: We monitor for signs of compromised customer equipment (such as botnet activity or spam transmission) and may notify affected customers.
- Network Monitoring: We monitor network traffic patterns to identify and respond to security threats. We do not inspect the content of customer communications.
Security measures are applied consistently and are not used to discriminate against or favor any particular content, applications, or services.
9. Network Performance
Detailed information about our service offerings, including typical download and upload speeds, latency, and pricing, is available on our FCC Broadband Nutrition Labels at the point of sale and on our website. As a fixed wireless provider, actual speeds may vary based on:
- Distance from the access point
- Line-of-sight conditions and obstructions
- Weather conditions
- Network congestion during peak usage periods
- Customer equipment and in-home network conditions
10. Data Allowances
Information about data allowances (if any) for each service plan is disclosed on the corresponding FCC Broadband Nutrition Label. Currently, our residential service plans include unlimited data with no monthly data caps or overage charges.
11. Changes to This Policy
We may update this Network Management Policy from time to time to reflect changes in our practices or regulatory requirements. Material changes will be posted on our website and, where appropriate, communicated to customers through service announcements.
